1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client" or "User") and AI Business Growth Firm ("Company," "we," "us," or "our"), governing your access to and use of our website at https://www.aibusinessgrowthfirm.com and all AI automation, custom agent development, lead generation, sales automation, and related services we provide.

By accessing our website, booking a strategy call, providing your phone number, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our website or services.

2. Description of Services

AI Business Growth Firm provides bespoke AI agent development and business automation solutions, including but not limited to:

• Custom AI Agent Development – Design and build of tailored AI agents for your business
• AI Lead Generation – Autonomous prospecting and lead qualification systems
• AI Sales Automation – Intelligent outreach, follow-up, and funnel automation
• AI Workflow Optimization – Process automation connecting existing business tools
• AI-Powered CRM & Pipeline Management – Lead scoring, tagging, and deal routing
• Analytics & Performance Intelligence – Reporting dashboards and ROI tracking

All services are custom-built to each client's specifications. Scope, deliverables, timelines, and pricing are defined in a separate Service Agreement or Statement of Work signed by both parties.

3. Eligibility

By using our services, you represent and warrant that: (a) you are at least 18 years of age; (b) you have full authority to enter into binding agreements on behalf of yourself or your organization; and (c) your use of our services does not violate any applicable laws or regulations.

4. Client Responsibilities

You agree to:

• Provide accurate, complete, and timely information necessary for us to deliver services
• Cooperate with our team during the discovery, build, and deployment phases
• Grant us access to relevant tools, platforms, and systems as required for integration
• Ensure your use of our AI solutions complies with all applicable laws, including anti-spam, data protection, and consumer protection regulations
• Not use our services for any illegal, deceptive, or harmful purpose
• Maintain the confidentiality of any credentials or access keys we provide

5. Intellectual Property

5.1 Our Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of AI Business Growth Firm and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

5.2 Custom Deliverables

Upon full payment of all fees, custom AI agents and automation systems developed specifically for your business will be assigned to you. We retain the right to use underlying frameworks, methodologies, and non-proprietary components in future client work.

5.3 License to Your Materials

By providing us with your data, branding, or content for the purpose of delivering services, you grant us a limited, non-exclusive license to use such materials solely for that purpose.

6. Fees and Payment

Service fees are outlined in your individual Service Agreement. Unless otherwise stated:

• Payment terms are as specified in the signed Service Agreement
• Invoices are due within the timeframe specified therein
• Late payments may incur interest charges or suspension of services
• All fees are non-refundable except as expressly stated in the Service Agreement or required by law

We reserve the right to update our pricing for new engagements with reasonable advance notice.

7. SMS / Text Messaging Terms

7.1 Program Description

AI Business Growth Firm operates an SMS messaging program (the "Program") through which subscribers receive (a) transactional messages, including strategy-call confirmations and appointment reminders, and (b) marketing messages, including lead follow-up, sales outreach, and promotional communications related to our AI automation and business growth services.

7.2 Consent

By providing your mobile phone number on any AI Business Growth Firm form or by texting us directly, you expressly consent to receive recurring automated marketing and transactional text messages from AI Business Growth Firm at the number provided. Consent to receive marketing text messages is not a condition of purchasing any goods or services.

7.3 Message Frequency

Message frequency varies based on your engagement with our services.

7.4 Cost

Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. AI Business Growth Firm does not charge for messages sent through the Program; however, your carrier may.

7.5 Opt-Out

You may cancel the Program at any time. Text STOP to the number from which you received messages. You will receive a one-time opt-out confirmation message. After that, you will not receive further messages unless you re-subscribe.

7.7 Supported Carriers

This Program is available on most major U.S. carriers. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.

7.8 Eligibility

You must be at least 18 years of age and the account holder or authorized user of the mobile number provided to subscribe to the Program.

7.9 Privacy

Information collected through the Program is governed by our Privacy Policy, available at https://www.aibusinessgrowthfirm.com. We do not share or sell mobile opt-in data or phone numbers with third parties or affiliates for marketing purposes.

7.10 Changes to the Program

We reserve the right to modify or terminate the SMS Program at any time, with or without notice. Material changes will be communicated through the Program or posted on our website.

8. Confidentiality

Both parties agree to keep confidential all non-public, proprietary, or sensitive information disclosed in connection with services ("Confidential Information"). This obligation does not apply to information that: (a) is or becomes publicly available without breach; (b) was already known to the receiving party; (c) is independently developed; or (d) is required to be disclosed by law.

9. Results Disclaimer

AI Business Growth Firm makes no guarantees of specific business outcomes, revenue increases, or lead generation results. While we have helped clients achieve significant improvements (including metrics referenced on our website), individual results depend on many factors outside our control, including but not limited to market conditions, client industry, product quality, and client cooperation.

Statistics and figures cited on our website (e.g., "10x Operational Efficiency," "300% More Qualified Leads") represent illustrative outcomes and are not guaranteed for every client.

10. Limitation of Liability

To the fullest extent permitted by applicable law, AI Business Growth Firm, its founders, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our services, even if advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising out of or relating to our services shall not exceed the total fees paid by you to us in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Business Growth Firm and its team from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your use of our AI systems in a manner inconsistent with applicable laws.

12. Term and Termination

These Terms remain in effect for the duration of your engagement with us. Either party may terminate a service engagement as specified in the applicable Service Agreement.

We reserve the right to suspend or terminate access to our services immediately if you: (a) breach these Terms; (b) fail to make required payments; (c) engage in conduct that is harmful, illegal, or damaging to our reputation.

Upon termination, all outstanding fees become immediately due. Provisions relating to intellectual property, confidentiality, limitation of liability, and indemnification survive termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or mediation, as mutually agreed.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Your continued use of our services after such changes constitutes your acceptance of the new Terms. We recommend reviewing this page periodically.

15. Entire Agreement

These Terms, together with any applicable Service Agreement, constitute the entire agreement between you and us regarding the subject matter herein and supersede all prior discussions, representations, or agreements.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
